These Terms & Conditions ("Terms") govern your access to and use of the Launch Automation website, software, and services ("Services"). By accessing the site, requesting a demo, or subscribing, you agree to these Terms.
1. The Services
Launch Automation provides an all-in-one sales, marketing, and CRM platform built for insurance agents, including websites, funnels, automations, AI tools, and communication features. Specific features and support depend on the plan you select (for example, Solve 1 Problem, DIY, or Done-For-You).
2. Accounts & Eligibility
You must be at least 18 years old and able to enter into a binding contract. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials and all activity under your account.
3. Subscriptions, Billing & Cancellation
- Plans are billed on a recurring monthly basis at the price listed for your selected plan until cancelled.
- You may cancel at any time; cancellation stops future renewals. Unless required by law, fees already paid are non-refundable.
- Carrier messaging fees (for SMS, calls, and email usage) and a one-time A2P registration fee are billed at cost and are separate from your subscription.
- Prices and plan features may change; we will provide notice of material changes as required.
4. Free Trials
Where a free trial is offered, it allows you to evaluate the Services for the stated period. Unless you cancel before the trial ends, your subscription may convert to a paid plan at the then-current rate. Trial terms presented at sign-up apply.
5. Acceptable Use & Messaging Compliance
You agree to use the Services lawfully and in compliance with all applicable regulations, including those governing electronic communications (such as the TCPA, CAN-SPAM, and carrier/A2P requirements). You are responsible for:
- Obtaining proper consent before contacting your leads and clients by SMS, call, or email.
- Honoring opt-out and do-not-contact requests.
- Not using the Services to send unlawful, deceptive, or unsolicited messages.
- The content of all communications you send through the platform.
6. Your Content & Data
You retain ownership of the content, contacts, and data you upload ("Your Content"). You grant us a limited license to host and process Your Content solely to provide the Services. You represent that you have the rights and consents necessary for Your Content and its use within the platform.
7. Intellectual Property
The Services, including software, templates, designs, and trademarks, are owned by Launch Automation or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription. You may not copy, resell, reverse engineer, or create derivative works except as expressly permitted.
8. Third-Party Services
The Services may integrate with or rely on third-party providers. We are not responsible for third-party services, and your use of them may be subject to their own terms.
9. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee specific business results, lead volume, conversions, or income. Any examples or figures are illustrative and not a promise of performance.
10. Limitation of Liability
To the maximum extent permitted by law, Launch Automation will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the three months before the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold harmless Launch Automation from claims, damages, and expenses arising out of Your Content, your use of the Services, or your violation of these Terms or applicable law.
12. Termination
We may suspend or terminate access if you violate these Terms or use the Services in a way that creates legal or security risk. Upon termination, your right to use the Services ends, and we may delete account data after a reasonable period.
13. Changes to These Terms
We may update these Terms from time to time. Updates take effect when posted, and we will revise the "Last updated" date above. Continued use of the Services after changes means you accept the revised Terms.
